CONDITIONS OF USE Listed here are the Terms & Conditions of Sale applicable to online purchases from Kate Hill's online Ordering system ("Kate Hill"). These terms and the laws of Victoria, Australia, apply to all transactions for the purchase of Kate Hill products ("Products") from Kate Hill through its web Site at www.katehill.com.au and any associated web pages or sub-Sites (the "Site"). Kate Hill does not offer or agree to any conditions, warranties, guarantees or representations relating to the quality, description or performance characteristics of the Products other than those set out in these terms. By visiting the Site the Customer accepts the terms and conditions of use relating to this Site. The Customer's completion of the Checkout form on this Site will constitute an offer to the Customer to purchase Products (the "Order"). All Orders are subject to acceptance by Kate Hill. PRICING AND PURCHASING The prices to be paid by the Customer for all Products will be Kate Hill's current selling price on the date of receipt by Kate Hill of the Order, less any applicable discounts in effect at that time. Orders can attract a delivery charge as set out on the Delivery Charges page of the Checkout. Kate Hill will notify a Customer in the event of a pricing error on the Site before an Order is delivered. And the Customer will have the opportunity to cancel their Order within a reasonable time. Kate Hill will not be responsible for errors in pricing that appear on the Site. Kate Hill reserves the right to change its prices from time to time without prior notice to the Customer. All prices on this Site include Australian Goods and Services Tax (GST). The GST payable by the Customer will be shown on invoice. If there are delivery charges to the nominated address, this will be advised to the Customer on the delivery screen and Order confirmation pages of the Site. In the unlikely event that a Product is "Out of Stock" when Kate Hill processes an Order, Kate Hill will contact the Customer to discuss revised delivery times or refund options. All Orders by the Customer under this Agreement must be placed via the fields provided on this Site and must specify the information requested, including (but without limitation): (a) Current billing address for invoices and statements. (b) Quantity and description of Products. (c) The full street address to which the Product is to be delivered. The Customer must complete all information requested in the fields provided before the Order is processed by Kate Hill. Kate Hill will not accept Orders if the Customer does not offer to pay by one of the credit cards or payment methods listed in this Site or if the Customers credit card provider does not confirm the payment or if the Customers credit account is on stop credit or has no available credit. Kate Hill will send the Customer an email acknowledging the Products Ordered as soon as possible after the Customer places an Order. If Kate Hill does not accept the Customers Order for any reason, it will inform the Customer by email in the same manner. Payment for Products purchased from Kate Hill via the Site can be made by VISA, MasterCard, Diners Club and American Express credit cards, or Paypal. Kate Hill will verify the credit card or credit account information submitted by the Customer and will advise the Customer that its Order has been accepted. The Customer agrees to submit to Kate Hill such information as may be reasonably requested by Kate Hill for the authorisation and verification of its credit card purchases. Kate Hill reserves the right to exercise its lawful remedies if a dispute arises over payment through the Customers credit card provider. In particular, but without limitation, if the Customers credit card provider rejects a payment when due, Kate Hill at its discretion may delay or cancel delivery of Orders placed by the Customer. If the Customers entire Order is cancelled prior to shipment Kate Hill will apply a credit to the Customers credit card whichever is applicable and may also apply a cancellation fee at its discretion. If an Order has already shipped Kate Hill's normal returns and exchanges procedure will apply. Kate Hill will arrange delivery of all Products to the Customer using its nominated freight carriers. A Customer must not arrange its own courier to collect the Products from Kate Hill. RISK Risk in the goods passes to the Customer upon delivery to the Customer. RETURNS No Products will be accepted for return without a Return Authorisation (RA) Number. A full credit/refund will be allowed on Products returned within 14 days of invoice. Product returned after 7 days and up to 14 days after invoice will still be eligible for a full refund/credit however we reserve the right to incur a handling charge of 10% of the selling price at our discretion. A reimbursement will not be allowed on Product returned after 14 days from invoice. Product returned for refund/credit must be freight paid to Kate Hill head office once authorised by a Kate Hill Returns officer at time of requesting the return, and invoice number, date and reason for return supplied. If due to a warehouse or other error on the part of Kate Hill, the Customer receives a Product which does not correspond or quadrate to its Order, the Customer must contact Kate Hill within 7 days of receipt of the Product and may obtain a replacement Product from the Site, after returning the original Product to Kate Hill, provided that the returned Product is in new condition with its original packaging unopened. KATE HILL GUARANTEE Customers can return Products purchased online from Kate Hill within 14 days of the purchase in its original packaging, unused and with swing tags still attached. Kate Hill products are made to ensure they last for the natural life of the product. Natural life is best described as normal wear and tear that will occur when an item is used for its intended use. For example, a leather handbag will eventually show signs of wear on the leather or scratches, cuts, dents and soiling. To keep your purchase looking its best, please follow the Kate Hill Product Care recommendations. Kate Hill will take responsibility of faulty goods or problems arising from defective workmanship as implied under the Trade Practices Act 1974. What is deemed as faulty or defective workmanship will need to be assessed on a case by case basis by Kate Hill Customer Service. Kate Hill will not accept or have any other responsibility or liability whatsoever for or in relation to the Product including liability for negligence or liability for incidental, consequential, indirect or special damages, including without limitation, loss of actual or anticipated revenue or loss of data or for date being rendered inaccurate.
